Terms and Conditions of sale

1. The Company’s standard conditions of sale are to apply unless agreed before hand in writing.
2. Prices displayed at the time of sale are inclusive of VAT.
3. These terms and conditions apply to your order for the purchases of furniture (“the furniture”) referred to overleaf from New Directions-Domus Artistica Limited (“the company”) and trading as Domus Artistica Furniture Store.
   They supersede and replace any inconsistent or additional terms and conditions of whatever nature made verbally by the company, its employees or agents.
4. Leather is a natural produce and is subject to dye, grain, shade variances and natural scarring, Each piece of    
   furniture is therefore unique ad will not match the showroom model exactly, Natural wood is also subject to shade and grain variation.
5. Goods remain the property of New Directions-Domus Artistica Limited until full payment has been received by the company.
6. Any balance outstanding is payable before delivery by Cash, Bankers Draft, Building Society issued cheque or
   Valid and accepted Debit or Credit Card. Payments be it personal or company cheque must be made at least 10
   Working days prior to delivery, to ensure clearance.
   • Delivery dates are given in good faith (time being expressed excluded as being of the essence for any orders  and the company shall not be liable for failure or delay in deliveries due to “force majeure” e.g. strike, act of God, shortage of raw materials or transport or other causes beyond our control). Deposits are not refundable.
7. DELIVERY
   • Once the company is in apposition to deliver the Furniture it will try to contact you by telephone to arrange a  convenient date and time for delivery. If the Company cannot contact you by telephone it will give you at least 5 working days written notice of the proposed delivery date.
   • The Company regret that storage facilities are not available. Customers are expected to take delivery of the within 10 days of notification unless previously agreed in writing with the store manager. In both cases any outstanding balance must by paid as soon as the goods arrive in our warehouse.
   • Although every effort will be made to effect delivery within the approximate time quoted, there may be occasions when later deliveries occur, Time will not be of the essence unless specifically stated on the order.
   • The Company only agrees to deliver to ground floor entrance any where on the U.K mainland, it is your responsibility to ensure there is adequate access and space to receive the Furniture on delivery. Delivery beyond the ground floor entrance may be undertaken at your sole risk and costs. If there are any physical obstructions to overcome, to effect delivery, the Company may make an additional charge.
   • There are no free deliveries whatsoever.
   • The Company shall not be held responsible for an inability to deliver in consequence of war, changes in fiscal policy, strikes, lockouts, fire, breakdown or any other contingency beyond its control.
8. You will be deemed to have accepted the Furniture and agreed that it is as ordered unless you notify the Company
   In writing with 5 working days of delivery, Compliancy with this requirement shall be a condition precedent to any claim for damaged goods.
9. Unless specifically stated in the agreement, finance payments will commence one month from the date when the Goods are delivered. In some cases, this is prior to delivery.
10. All goods are subject to manufacturer’s terms of warranty which agree to repair or replace at the manufacturer’s discretion within 12 months of the goods being delivered to New Directions-Domus Artistica Limited. Remedial work carried outside of this period will be on a chargeable basis. 
11. Where the furniture is exported and you then notify the company of a defect as specified in 8 above, the Company reserves the right to examine the Furniture in the UK before repairing or replacing the defective item. It is your responsibility (at your own cost) to return the Furniture to the UK for inspection. Repaired or replaced Furniture will then be delivered to any address you specify in the UK (at your own costs).
12. These conditions shall be governed by and construed in accordance with English laws and the parties shall submit to the non-exclusive jurisdiction of the English courts.
13. We are committed to you, our customer, and by signing this document, you are committed to us. Unfortunately no cancellation can be accepted once an order has been placed.
